Terms and Conditions
1. Scope
These Terms and Conditions govern the use of the Baulens platform (the "Service"), operated by Murat Kilic (the "Operator"; further details in the Imprint). By using the Service you agree to these Terms.
2. Services
Baulens presents structured information on new construction projects in Switzerland. The content shown comes exclusively from publicly accessible sources, in particular the Swiss Federal Register of Buildings and Dwellings (GWR), cantonal and municipal gazettes, and other government data in accordance with the respective terms of use. In addition, the Service may contain references (hyperlinks) to publicly accessible project and marketing pages of the respective developers or marketers. The respective operator is solely responsible for the content of these linked pages. Baulens is a pure information platform. The Operator is expressly not a real-estate broker, developer, or seller. No contracts are brokered between users, builders, brokers, sellers, or tenants. Baulens does not ingest content from protected or contractually restricted third-party sources (in particular no content from commercial real-estate portals).
3. Subscription
Use of the Service requires a paid subscription. The prices, terms, and feature scope in force at any given time are stated on the website.
4. Conclusion of Contract and Cancellation
The contract is concluded upon successful completion of a subscription. Subscriptions are automatically renewed for the respective term unless cancelled before the end of the current period. Cancellation is possible at any time via the user account and takes effect at the end of the current billing period.
5. Data Accuracy and Disclaimer
The Operator makes every effort to keep the content current, complete, and correct. However, no warranty is given as to the accuracy, completeness, or timeliness of the information shown. The data is based on external, publicly accessible sources whose correctness and timeliness lie outside the Operator's control. The content shown does not replace independent research or professional advice (in particular from architects, fiduciaries, lawyers, or real-estate experts). Decisions made on the basis of the information provided are taken solely at the user's own risk.
6. Usage Rights and Prohibited Use
Use of the Service is permitted for private, non-commercial purposes. The following are prohibited in particular: • automated extraction of content (scraping, crawling, API abuse); • systematic reproduction, redistribution, or commercial exploitation of the content shown; • circumvention of technical protection measures or access restrictions; • any use that may disrupt the Service or impair its availability for other users. Breaches entitle the Operator to immediately block access without refund of any subscription fees. Further legal steps are reserved.
7. Copyright
The processing, presentation, structuring, and visualisation of the content on Baulens are protected by copyright. The underlying raw data comes from publicly accessible sources and is subject to the respective terms of use of those sources. The Operator does not claim any rights to the public raw data of third parties; only the independent processing is protected.
8. Availability
The Operator strives for the highest possible availability of the Service but does not guarantee uninterrupted accessibility. Maintenance, technical faults, third-party interventions, or force majeure may lead to temporary restrictions without giving rise to claims against the Operator.
9. Limitation of Liability
To the extent permitted by law, the Operator's liability is limited to intent and gross negligence. Liability for slight negligence, indirect damage, consequential damage, lost profits, or damage arising from decisions based on the content shown is excluded.
10. Changes to the Terms
The Operator reserves the right to amend these Terms. Material changes will be communicated to users at least 30 days before they take effect, by email or via the platform. If material changes are rejected, users have a special right of termination effective on the date the changes take effect.
11. Governing Law and Jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zurich, unless mandatory legal provisions (in particular in favour of consumers) require a different place of jurisdiction.
12. Complaints Concerning Specific Content
If authorities, developers, data providers, or other rights holders raise complaints about specific content shown, the Operator will review the submission upon receipt of a written notice to info@baulens.ch and will promptly remove or correct any content that is legitimately challenged.
